TVB, ATV fined HK$200,000 each

Television Broadcasting (TVB) and Asia Television (ATV) were each fined HK$200,000 by the Communications Authority for their deal to alter their approved share of public airwave. The two stations had been granted permission to equally share the transmission capacity of a “multiple frequency network” at no fee. The regulator found out in March that TVB had entered a deal with ATV in early 2013 to eat into ATV’s capacity. As the deal was done without the regulator’s approval, it was considered a licensing breach. The fine of HK$200,000 is the steepest allowed by law for a first offense. The authority said the amount was fixed on the premise that spectrum is a scarce public resource.
