Indonesia enacts new criminal code, new criminal procedure code

JAKARTA – Indonesia on Friday officially enacted its National Criminal Code and a new Criminal Procedure Code, marking a major step in reforming the country's criminal justice system.

The new laws replace long-standing regulations, including provisions inherited from the colonial period.

Coordinating Minister for Legal, Human Rights, Immigration, and Correction Yusril Ihza Mahendra said the move marked the end of the colonial-era criminal law system and the beginning of a more modern and humane approach to law enforcement.

According to Yusril, the new Criminal Code places greater emphasis on restorative justice. In addition to imprisonment, it allows for alternative penalties such as community service, rehabilitation, and mediation.

The new Criminal Procedure Code strengthens rules for investigation and trial, improves oversight of law enforcement authorities, and enhances protection for victims and witnesses. It also encourages the use of digital technology to improve efficiency in the justice system.
